Now a joint filing from Hyperliquid Policy Center and trade[XYZ] is asking the Commodity Futures Trading Commission to do something straightforward yet still controversial: let regulated energy perpetual contracts live inside the U.S. system.
Why Energy Perpetuals Matter Right Now
Perpetual contracts never expire. Instead of rolling a position into the next delivery month, traders settle a recurring funding payment that keeps the contract price tethered to the underlying asset. For crude oil and natural gas that simple design change opens a door traditional futures leave shut every weekend and holiday.
trade[XYZ] has been running these markets on Hyperliquid since October 2025. The cumulative volume across its products has already passed the half-trillion-dollar mark. That figure covers more than just energy, yet the energy contracts themselves have proven they can move in real time when conventional venues are dark. In my view, that track record is hard to ignore.
The Weekend Gap Nobody Talks About Enough
Picture late February. Conflict flares in the Middle East. Energy export routes face disruption. U.S. futures markets close for the weekend. Airlines, refiners, and fund managers holding crude exposure have no regulated way to adjust positions until Sunday evening. Meanwhile the onchain crude perpetuals keep trading. By the time the benchmark reopens, roughly two-thirds of the eventual price move has already shown up in those continuous markets.
Brent later climbed toward $120 a barrel. Jet-fuel prices roughly doubled in the following weeks. The filing points out that the continuous market absorbed the shock while the traditional complex sat idle. I’ve sat through enough risk-management meetings to know how uncomfortable that idle period feels for anyone with real physical exposure.

Research cited in the submission compared perpetual prices with the subsequent Sunday reopening levels. Across nearly three-quarters of the weekend closures examined, the perpetual finished closer to the new opening price than the previous Friday close. That kind of anticipatory accuracy is exactly what risk managers want when the calendar forces a pause.
Do Perpetuals Undermine Traditional Benchmarks?
One of the quieter but more important claims in the filing is that the launch of the crude perpetual did not produce any statistically measurable drop in the quality of CME WTI reopening prices. In other words, the two products can coexist. Dated futures still matter for physical settlement, for specific delivery months, and for anyone trading the shape of the curve. Perpetuals simply give continuous price exposure without the rolling process.
Contract size is another practical difference. A standard WTI futures contract covers 1,000 barrels—around $70,000 notional at recent prices. The median off-hours crude trade on the continuous market was closer to $1,300. Smaller tickets lower the barrier for a wider set of participants who still need to manage risk but cannot always commit to full futures size.
Earlier this year an established exchange operator licensed its Brent and WTI prices for perpetual contracts offered outside the United States. That move signaled that traditional infrastructure players are already exploring around-the-clock energy products. The question now is whether U.S. regulated markets will follow or remain limited to conventional hours.
What the CFTC Is Actually Reviewing
In June the Commission opened a public comment period on two related topics: extending standard energy futures into continuous trading hours and listing perpetual contracts linked to physical or storable energy commodities. The review covers reference-price reliability, manipulation risks, surveillance, position limits, margin, clearing, customer protections, and potential spillover effects on physical markets.
After adding questions and receiving requests for more time, the deadline was pushed to August 26. The agency has made clear it wants a data-driven record before any decision. Approval is not guaranteed. The consultation itself is simply the first formal step.
There is already a limited precedent. The Commission previously approved a Bitcoin perpetual as a futures contract, but that analysis stayed narrow. Digital commodities with deep, continuous spot markets are not the same as crude oil or natural gas. Energy products carry physical delivery systems, storage constraints, and benchmarks that behave differently. Separate consideration is required, and the current filing tries to supply exactly that.
Onchain Infrastructure as the Operating Backbone
The groups argue for a technology-neutral framework. Exchanges and clearinghouses would still have to demonstrate compliance with existing core principles. The difference is that onchain systems can keep trading, margin checks, clearing, settlement, and surveillance running around the clock.
Under the model described, positions are funded in advance. Margin is recalculated with every transaction rather than waiting for a scheduled settlement window. Standard order-book liquidations have handled the vast majority of liquidated notional volume—97.9 percent according to the filing. Predefined backstop and tail-loss processes covered the rest.
Because every transaction, margin change, and liquidation appears on a public ledger, real-time surveillance becomes possible without layering new reporting requirements onto every participant. Any U.S. operator would still need to satisfy rules on market integrity, customer protection, and recordkeeping. The claim is simply that the existing toolkit can be applied to continuous, transparent infrastructure.
A recent data integration that brought these prices onto a widely used charting platform already lets users monitor commodities, equities, foreign exchange, and crypto outside traditional exchange hours. Visibility is no longer the bottleneck. Regulatory clarity is.
Stablecoins and Weekend Collateral
Bank wires stop on weekends. Blockchain-based collateral does not. The filing asks the Commission to recognize eligible stablecoins and tokenized traditional assets as margin for cleared derivatives. Current policy already allows certain digital assets in some cleared transactions under a pilot program that covers Bitcoin, Ether, and qualifying stablecoins, subject to reporting, capital, and risk-management rules.
What the groups want is clearer guidance on how that treatment would extend to energy markets. They are not asking for crypto collateral in uncleared swaps. The request stays inside the existing pilot framework and simply seeks to remove ambiguity for continuous energy products.
Alongside collateral rules, the submission proposes leverage limits calibrated to the asset class and plain-language disclosures that explain funding payments and liquidation mechanics. Market-integrity measures would still need to address price manipulation and the reliability of reference benchmarks during periods when physical markets are inactive.
Several existing requirements are written around conventional business-day clocks. Deadlines tied to the next “business day” make less sense when the exchange, the clearing system, and the collateral network never stop. The filing asks the regulator to clarify how those terms would apply in a 24/7 environment.
Practical Differences Between Futures and Perpetuals
Let’s be concrete. Dated futures remain essential for anyone who needs physical delivery or wants exposure to a particular month on the curve. They also support the sophisticated basis trading that has developed over decades. Perpetuals do not replace that toolkit. They complement it by removing the need to roll and by staying open when the rest of the market is closed.
I’ve found that risk managers often prefer the simplicity of a continuous contract when their primary goal is directional hedge coverage rather than calendar-spread positioning. The funding rate mechanism keeps the perpetual close to spot without forcing a monthly decision about which contract to hold next. For many commercial users that operational simplicity has real value.
At the same time, the smaller median trade size observed in the continuous market suggests a different participant mix. Some of those tickets come from professional desks testing the waters; others come from smaller commercial entities that simply cannot justify a full 1,000-barrel futures position every time they need to adjust exposure.
Surveillance and Integrity in Continuous Markets
Any regulator will focus on whether continuous trading increases manipulation risk. The public ledger argument is that transparency itself becomes a surveillance tool. Every fill, every margin adjustment, and every liquidation is visible. That does not eliminate the need for traditional market-surveillance teams, but it changes the cost and speed of investigation.
Position limits, large-trader reporting, and other core safeguards would still apply. The filing does not ask for exemptions. It asks for the same standards to be applied to infrastructure that happens to run onchain. In my experience, that technology-neutral stance is usually the most productive path for regulators who want innovation without sacrificing integrity.
Reference-price reliability is another legitimate concern. When physical markets are closed, what anchors the perpetual? The groups point to the empirical record: the continuous prices have tracked subsequent reopenings closely enough that the anticipatory signal is useful rather than destabilizing. Whether that pattern holds under every stress scenario is something the Commission will weigh carefully.
What Happens If the Path Opens
If the CFTC ultimately provides a clear legal route, regulated venues could list energy perpetuals under existing core principles. Clearinghouses would need robust risk models that account for continuous margin flows. Futures commission merchants would need to handle stablecoin or tokenized collateral under the clarified rules. None of those steps requires brand-new legislation, according to the filing. They require interpretation and application of the framework already in place.
Perhaps the most interesting aspect is the competitive pressure this creates. Traditional exchanges that have already licensed their benchmarks for offshore perpetual products will face a choice: bring similar offerings into the U.S. regulated space or leave that segment to newer platforms. Either outcome expands the set of tools available to commercial hedgers.
For the physical energy complex the stakes are practical. Better weekend coverage reduces the gap risk that currently sits on corporate balance sheets every Friday. Smaller contract sizes lower the entry point for mid-sized participants. Continuous price discovery during geopolitical events gives everyone a clearer real-time signal.
Balancing Innovation and Caution
No one should pretend the decision is risk-free. Continuous markets can amplify leverage if safeguards are weak. Funding-rate dynamics can create their own feedback loops. Reference prices during thin physical periods need careful design. These are real issues, and the Commission is right to demand data.
At the same time, the status quo also carries cost. Every weekend that commercial users cannot adjust exposure is a period of unhedgeable risk. When that risk materializes in the form of sudden price spikes, the economic impact lands on airlines, refiners, utilities, and ultimately consumers. Closing that gap inside a regulated framework is, in my view, worth serious consideration.
The filing tries to meet the Commission halfway. It supplies volume data, anticipatory-price studies, liquidation statistics, and concrete proposals on margin, leverage, disclosures, and surveillance. Whether those materials prove sufficient remains to be seen. What is already clear is that the conversation has moved from theoretical to operational.
Looking Ahead
Energy markets have always balanced physical reality with financial innovation. Pipeline constraints, storage levels, and geopolitical flashpoints remain the ultimate drivers. Financial contracts simply determine how efficiently risk is transferred among participants. Adding a continuous, smaller-sized, non-expiring product does not change the physical fundamentals. It changes the speed and accessibility of the risk-transfer layer.
Hyperliquid Policy Center has also argued for a parallel equity framework with the Securities and Exchange Commission, suggesting that the broader conversation about perpetual-style contracts is expanding beyond commodities. For now the energy filing stands on its own merits and on the concrete experience already generated in the continuous markets.
I’ve watched enough regulatory cycles to know that first comments rarely produce immediate green lights. They produce better questions, more data requests, and eventually clearer rules. The August 26 deadline simply marks the end of one formal comment window. The real work of interpreting those comments and deciding next steps will continue for months.
Still, the core proposition is straightforward. Continuous energy risk management already exists in practice. The only question is whether it will be allowed to operate under the same regulatory umbrella that covers traditional futures. For commercial users who have spent too many weekends watching prices move without a regulated way to respond, the answer matters more than most abstract policy debates.
The numbers are already on the table: more than half a trillion dollars of cumulative volume, consistent anticipatory pricing ahead of weekend reopenings, and liquidation mechanics that have handled nearly all notional volume through ordinary order-book processes. Those facts do not guarantee approval. They do, however, give the Commission a concrete record to examine rather than a purely theoretical product.
In the end the decision will rest on whether the safeguards can be made robust enough and whether the benefits of continuous access outweigh the incremental risks. From where I sit, the case for at least testing a carefully designed path is strong. Commercial hedgers have lived with the weekend gap long enough. Giving them a regulated way to close it seems less like radical change and more like overdue modernization.
Whatever the Commission ultimately decides, the conversation itself has already shifted. Energy perpetuals are no longer an exotic idea confined to offshore platforms. They are a live policy question backed by real trading history and a formal request for clarity. That alone marks progress.
